[TODO: EN] These terms apply to all rental contracts between Energie 4760 ("the lessor") and the lessee for the vehicles listed in the online catalogue. Any conflicting terms of the lessee are excluded even without explicit objection.
[TODO: EN] §2 Contract conclusion
[TODO: EN] Submitting the online booking constitutes a binding offer. The contract is concluded when the lessor confirms the booking by email after reviewing the driver data. The lessor may reject a booking without stating reasons, e.g. for missing driving authorisation or negative records from prior rentals.
[TODO: EN] §3 Driver and license
[TODO: EN] Only the driver named on the booking may drive the vehicle. The minimum age depends on the vehicle but is never below 21 years; the license must have been held for at least two years and cover the required class. Originals (ID + license) are checked at handover. Without valid originals no vehicle is released; any costs already incurred are retained per the cancellation schedule (§7).
[TODO: EN] §4 Rent, included kilometres and deposit
[TODO: EN] Daily rate, included kilometres per day and the deposit are specified in the catalogue and the booking confirmation. Each kilometre beyond the free allowance is charged at the catalogue rate. The deposit is held (not charged) on the credit card at handover and released promptly after compliant return.
[TODO: EN] §5 Handover and return
[TODO: EN] Handover and return take place at the Büllingen site at the agreed time. Both parties sign a protocol with photo documentation. The vehicle is handed over full and must be returned full; otherwise a refuelling fee of 25 € plus the missing fuel at current pump price is charged.
[TODO: EN] §6 Late return
[TODO: EN] For the first late day started a flat fee of 60 € applies. From day two onwards this fee rises by 10 % over the previous day, cumulatively. The lessee remains liable for consequential damages, in particular if a following booking cannot be served; the lessor reserves the right to claim further damages.
[TODO: EN] §7 Cancellation
[TODO: EN] Free cancellation up to 4 days before start. Afterwards: 3 days 10 %, 2 days 20 %, 1 day 60 % of the total. No-show without prior notice: 100 %.
[TODO: EN] §8 Usage rules
[TODO: EN] Prohibited in particular: smoking in the vehicle (cleaning fee 150 €), transporting animals without prior agreement, travel outside EU/EFTA without written authorisation, racing or driver training, off-road use, sub-letting. Trailer operation only with suitable factory equipment and prior agreement.
[TODO: EN] §9 Damage, accident and theft
[TODO: EN] Any damage or breakdown must be reported to the lessor by phone without delay. In case of an accident the police must be called and a police report created; without it insurance coverage lapses. Leaving the accident site before the police arrives is grounds for exclusion of insurance cover and leads to full liability of the lessee.
[TODO: EN] §10 Insurance and excess
[TODO: EN] All vehicles carry third-party liability insurance. The optional comprehensive packages with tiered excess are chosen during booking and listed in the contract. Coverage does not apply in case of gross negligence or intent, notably under §6, §8 and §9.
[TODO: EN] §11 Lessor's liability
[TODO: EN] The lessor's liability is limited to intent and gross negligence; personal injury is unaffected. If the booked vehicle is unavailable the lessor will attempt to provide an equivalent replacement but is not obliged to do so. Payments made will be refunded pro rata in that case.
[TODO: EN] §12 Data protection
[TODO: EN] Personal data is processed according to the privacy policy (/datenschutz). Photos of ID and license are deleted at the latest 90 days after the rental ends. Invoice data is retained for 10 years. In a damage case, data required to establish, exercise or defend legal claims is retained until the claims become time-barred (Art. 17(3)(e) GDPR).

[TODO: EN] Belgian law applies. Venue is Eupen where legally permitted. If individual provisions are invalid the remainder stays in force. Amendments require text form. The current version is available at /agb.
